These Terms & Conditions (“Terms”) govern your use of this website and purchases from SunnyTown, operated by NIUESS. By using the website or placing an order, you agree to these Terms. If you do not agree, please do not use the website.
1. Eligibility and Accounts
You must be at least 18 years old, or the age of majority where you live, to place an order. You are responsible for providing accurate account, billing, shipping, and contact information and for keeping your login credentials secure. We may suspend accounts used fraudulently or unlawfully.
2. Products and Fragrance Descriptions
SunnyTown sells fragrance products for retail, refill, sample decant, gifting, wholesale, and custom scent applications. Product photos, colors, packaging, scent descriptions, notes, and performance information are provided as accurately as reasonably possible, but screens, batches, storage conditions, skin chemistry, and individual perception may cause differences.
References such as “inspired by,” comparisons, scent families, or third-party fragrance names are used only to describe the scent direction or customer search intent. SunnyTown is an independent business and is not affiliated with, endorsed by, sponsored by, or licensed by the referenced brand owners. Third-party trademarks remain the property of their respective owners.
3. Safe Use
Fragrance is for external use only. Avoid eyes, broken or irritated skin, ingestion, flames, sparks, and heat. Keep out of reach of children and pets. Review product information before use, patch test when appropriate, and discontinue use if irritation occurs. Customers are responsible for using, storing, decanting, and reselling products safely and lawfully.
4. Prices, Availability, and Product Information
Prices are shown in U.S. dollars unless stated otherwise. Prices, tier discounts, shipping charges, promotions, specifications, and availability may change without notice. We may correct typographical, pricing, inventory, or product-information errors and may cancel affected orders. If payment has been captured for a cancelled item, it will be refunded.
5. Orders and Acceptance
An order confirmation acknowledges that we received your order; it does not guarantee acceptance. We may refuse, limit, hold, or cancel an order because of suspected fraud, payment failure, inventory, pricing error, shipping restriction, unsafe destination, resale concern, or other legitimate business reason. We may limit quantities per customer, address, or order.
6. Payment, Taxes, and Duties
You authorize us and our payment providers to charge the amount shown at checkout. You are responsible for applicable sales, use, import, customs, value-added, and similar taxes or duties unless they are collected at checkout. International customers are responsible for customs clearance and destination-country requirements.
7. Shipping and Delivery
Eligible U.S. orders may ship from our Kansas warehouse using compliant ground transportation. Other countries may be served through our own Shenzhen factory using an eligible carrier and shipping method. Carrier, service, and delivery availability depend on product size, destination, and fragrance shipping regulations.
In-stock U.S. orders normally ship within 2 business days. Delivery estimates are not guarantees. If we cannot ship within the time promised when you ordered, we will notify you and offer the choice to accept a revised shipping date or cancel the unshipped order for a full and prompt refund. 8. Returns and Refunds
Returns and refunds are governed by our Return & Refund Policy, which forms part of these Terms. Nothing in these Terms limits non-waivable consumer rights.
9. Wholesale, Custom Scent, and Private-Label Orders
We support wholesale and custom scent requests from a catalog of 3,000+ fragrance options. Pricing, minimum quantities, samples, deposits, production timing, artwork, packaging, quality tolerances, intellectual-property responsibilities, shipping, and cancellation terms may be specified in a separate quotation, invoice, or written agreement. If a project document conflicts with these website Terms, the project document controls for that order.
Buyers who provide names, logos, packaging, artwork, formulas, or claims represent that they have the right to use them and that the requested product and labeling comply with applicable laws in the destination market.
10. Intellectual Property
The SunnyTown name, website design, original text, graphics, logos, photographs, videos, and other original site content are owned by or licensed to SunnyTown and may not be copied, republished, sold, or commercially exploited without written permission. Permitted personal use does not transfer ownership.
11. Reviews and User Content
If you submit a review, photo, message, or other content, you confirm it is truthful, lawful, and your own or properly authorized. You grant SunnyTown a non-exclusive, worldwide, royalty-free license to display, reproduce, and use that content for website and marketing purposes. We may remove spam, unlawful content, personal information, or content unrelated to the product experience.
12. Prohibited Uses
You may not misuse the website, attempt unauthorized access, introduce malicious code, scrape or copy the site for commercial purposes, interfere with checkout, commit fraud, violate another party’s rights, or use our products or services for unlawful purposes.
13. Third-Party Services
The website may use or link to third-party payment, shipping, analytics, messaging, and social platforms. Their services are governed by their own terms and privacy practices. We are not responsible for third-party websites or services outside our reasonable control.
14. Disclaimer and Limitation of Liability
To the fullest extent permitted by law, the website and its content are provided on an “as available” basis. We do not guarantee uninterrupted or error-free access. SunnyTown is not liable for indirect, incidental, special, or consequential losses arising from website use or product purchase when such liability may lawfully be limited. Our total liability for a claim will not exceed the amount paid for the product giving rise to that claim. These limitations do not apply where prohibited by law or to liability that cannot legally be excluded.
15. Changes to These Terms
We may update these Terms to reflect operational, legal, or service changes. The effective date above shows the latest revision. Updated Terms apply after they are posted and do not retroactively change an accepted order unless required by law or agreed with you.
16. Severability and No Waiver
If any provision is found unenforceable, the remaining provisions remain effective. A delay in enforcing a provision is not a waiver of that provision.
